Parental Leave* for freelancers

N.B. We are using *Parental Leave as an inclusive term BUT much of the government guidance and details related to pay/leave entitlement is gendered – see glossary below.

Parental Leave also refers to unpaid leave you are entitled to take (as an employee) across a year (or up to the age of 18) to support the welfare of your child (See glossary).

Faith Dodkins (She/Her)

Faith Dodkins, a freelance producer based in Brighton, has generously shared her experience of taking parental leave with her child.

Faith is a freelance producer working across artforms in the UK and internationally. She collaborates closely with artists and organisations to conceive, develop and deliver unusual projects, combining skills and ambition to produce something magical. She is Executive Producer with theatre company TalkShow and has recently worked with trailblazing artists Bryony Kimmings and Hunt & Darton.

Faith is also Co-Artistic Director and Co-Founder of The Spire, a performance and development space located in East Brighton.  At The Spire she has commissioned and produced work by UK artists including Abigail Conway, Tim Spooner and Sheila Ghelani for high profile presentations in Brighton Festival.

Faith leads ‘Safe + Equal’, a pilot project exploring the safety and equality of women working in the arts and cultural sector in Brighton & Hove, sits on the Space to Grow working group (part of Brighton & Hove’s ABCD Plan for Cultural Recovery) and is a Director of the East Brighton Trust. She has a four year old son, Franklin.

Faith’s Reflections

  • What are some key things that cropped up for you when you were planning for and taking parental leave?   

The time between finding out I was pregnant, planning for and then taking parental leave whizzed by in a flash! Being freelance and having limited support systems, like an HR department or a senior manager, around me meant that I didn’t really think about it until much closer to the time than some people I would imagine. Alongside this, a contract I’d been promised would be renewed wasn’t – this happened about a week after telling the organisation I was pregnant and that I would be taking time off (this organisation is a very large, high profile arts employer that I’d been working with for two years on an international, multi-partner, programme). This situation meant I was skeptical of how a) my industry would support my decision to take the time off and b) how quickly I could put in place a plan to actually allow me to do so.

In this time the key thoughts that cropped up included:

  • How was I going to manage financially
  • How could I stay on the radar + continue to be part of the networks + conversations moving at a fast pace
  • How was I to manage my current projects without a huge team + financial resource
  • How could I best stay connected with industry developments (+ did I want to stay in touch with industry developments?)
  • How long did I want to be on leave, or most appropriately, how long could I afford to be on leave?
  • Did you have any strong feelings about how you might approach parental leave with regards to your projects or freelance work?

To be honest, I was really unsure! I guess our industry is pretty bad at sharing information on parental leave / being a parent and working freelance and in the independent sector. It was a case of speaking with the few people I was working with who are parents and trying to understand the impact of the situation – looking at the positives and taking it from there. I wanted to feel calm and in control of taking parental leave as a freelancer but in reality it wasn’t always easy to pull this off.

  • Were you able to take a period of time off? Did you feel it was viable as a freelancer? What did you consider when returning from parental leave?

Yes, I think in the end I took about 8 months off – 6 months covered by the governments’ weekly allowance. I did keep in contact with both my major projects throughout the 8 months and checked in with emails from time to time, but mainly I spent that time with my child getting to grips with life as a parent, which was a wonderful privilege.

Once we found childcare which suited our situation and which we could just about afford, I started off working two or three mornings a week – plus over nap times and in the evening. It wasn’t ideal but it was the only viable way to manage work and family life which didn’t break the bank. I spent a good few hours each week catching up on emails with a baby on my chest, rushing back to my laptop when he went down for a nap, manically typing before he woke up again or taking calls while pushing the buggy along the seafront!

Before returning to work I considered:

  • The balance between income generated through work v childcare costs
  • Should I work at home or go back to a shared office space
  • How to mentally and practically manage work and a small baby (after 8 months I was still feeding him at least twice during the night, sometimes more)
  • What impact would me working have on my child? Would he be ok, was he too small to be left, would I miss out on his development, what would people think if I left him, what would people think if I didn’t return to work? Lots of guilt across the board.

I think in reality, to return to work in the way that I did was only really viable because we had another income in the household that wasn’t freelance and also because I had made a career for myself which could be flexible and that I was able to juggle.

  • How has becoming a parent impacted the way you work? Are there things that you have adjusted, things you take into consideration that affect what you work on?

Most definitely! It has put lots of things in perspective – I’m more confident in my ability to do things well, I’m marginally less worried what other people think of me (that’s a work in progress), I allow myself to be less focused on work, but also more focused when it’s work time – it’s a rollercoaster. I am faster and more efficient, I get stuff done.

I think I now have a much fuller understanding of other people’s needs and other people’s work patterns. I realise I can’t do everything – I still try, but sometimes I let people down because my child needs me. It’s not the end of the world and people understand. I take my work very very seriously but also understand that I’m not a doctor in A+E, I’m not saving any lives…

  • What kind of things did you think about when on parental leave in terms of your producing practice… did it give any time to think? (!)

I can’t say that I had lots of time to think about my practice during that time, only reaffirming that I really like my job and am very lucky to be doing it most of the time. The experience of losing a contract when pregnant taught me to be tougher and to manage my expectations of other people / the industry; I guess I spent a bit of time reflecting on that while on leave. I realised that I only want to work on projects I really value, with people I really like. My time away from my child is precious and I’m privileged that I can focus my energies on projects that I think are important (for a variety of reasons) – I don’t want to waste time! I also assessed and then upped my day rate – which I think all freelance producers should do on a regular basis.

  • Were there any unexpected outcomes of taking parental leave?   

I think I’ve got to the point now where I understand that taking leave is really beneficial. Not just a few days here and there but a good amount of time to be with the family and re-charge. It’s taken 4 years of squeezing actual leave in since parental leave in 2018/19 but now I get it.

I also now talk to my child about the value of my work and why I want to go to work. I think taking parental leave and then making the decision to return to work solidified my love for my job. I want him to see that I like going, that it’s important to me to contribute financially and I have a life away from him. I want to be a positive role model for my child and work is a part of that – I don’t think I would have thought that as much if I hadn’t had time away from work.

  • Where did you look to for advice? 

Other parents, mainly. There’s really not much out there, very few resources for new parents navigating the freelance theatre landscape.

When I was pregnant and didn’t get my contract renewed Pregnant then Screwed was a helpful resource – I wish I’d leaned on them more, the outcome may have been different.

  • If you were to approach it again would you do things differently?

I don’t think I would approach things much differently, I handled it in the same way I handle most things I think, and I’ve been pretty lucky to have a mainly enjoyable experience. I guess, maybe worry less that people would forget me and remember that I have lots of experience to pick up where I left off. Three practical things:

  • Try (it’s hard) to save some money for the period of leave – the allowance does not go very far
  • Remember that you don’t have to tell your employer you are pregnant until 15 weeks before the beginning of the week the baby is due (I have learnt the hard way that not everyone values honesty as much as I do)
  • Join a union!
  • What support network, or support in general did you have, or do you wish you’d had?

As I said above, there wasn’t much. Colleagues and friends in the industry were 99% supportive + seemed genuinely happy for me and happy to see me return to work. There is a good network of producers, artists and cultural workers in Brighton – I guess having something more formal may have been helpful.

  • In what ways has this impacted your understanding of this role, and/or the role of producer in the wider sector?
  • How precarious the work can be (low wages, no paid sick leave, short term contracts, no HR)
  • How much expectation there is placed on producers and how this can take its toll
  • How spinning plates is the norm
  • How much I like my job + how privileged I am to make a living from it / but how it can sometimes be (or feel) undervalued
  • How having children + working in our sector should be conducive but the formal support is often lacking
  • Childcare is key (*tax free childcare / 30 free hours – why does nobody tell you about these things in advance!!)! But, if you can’t access it or can’t afford it you will struggle to be able to work. I wonder how many experienced + brilliant producer parents have had to leave the industry or cut their work back because of unaffordable, inaccessible childcare!!

 

Glossary of terms:

Maternity leave: time you are entitled to take off from work as a mother

Paternity leave: time you are entitled to take off from work as a father (unpaid if you are a freelance father)

Shared Parental leave: sharing leave between parents – this is only possible if both parents are in paid employment, or in a couple where one parent is a the birth mother and one the partner, and one is is in paid employment. Often this is taken as 9 months to one parent and 3 months to another, bt can be split according to your wishes and taking time off together or separately.

Maternity Allowance: Financial support you can apply for as a freelance mother – apply as soon as possible to ensure payments start when you stop work – you state a date for MA to start before you give birth in your application (details of the number to call if you give birth prematurely in Maternity Action blog below: MA Claims on 0800 169 0283) – this cannot be split with a freelance partner currently

MA is paid by the Department for Work and Pensions (DWP) for 39 weeks. If you are self-employed, Maternity Allowance for 23/24 is paid at £172.48 per week  (£6726.72 in total, for 39 weeks approx 9 months) if you have paid sufficient NI contributions, or £27 per week if you have not paid NI contributions. You can tick a box in the application form to top up your NI payments to become eligible for the higher weekly rate.

KIT days: freelance parents are entitled to work up to 10 ‘keeping in touch’ or KIT days across their maternity allowance period. This includes paid work as well as any other work you do to maintain your business such as admin & replying to emails (!) you are required to keep track of these and report to DWP if you work over the 10 days.

Unpaid Parental Leave: For employees who have worked for an employer for over 1 year to take unpaid parental leave to look after their child’s welfare https://www.gov.uk/parental-leave

Useful freelancer info:

  • Maternity allowance can be applied for for up to 39 weeks (9 months) and taken up to 11 weeks before the baby is born
  • If a two parent household: and both parents are freelance mothers, only one can apply for and receive maternity allowance, the other would need to be on unpaid leave unless the allowance is split
  • Freelance fathers are not entitled to any leave or paternity pay and need to take unpaid leave
  • Apply for child benefit – this is an amount paid per month to help with costs of raising a child
  • Explore and apply for childcare options early (i.e. nursery can be costly and waiting lists long)
  • When you come to returning to work ensure you apply for tax free childcare – HMRC will top up payments you make into an account by 20% – meaning a real contribution to childcare costs

 

Sally’s Reflections:

Sometime before I actually needed to take parental leave, I was feeling very concerned with whether my working life would be able to accommodate a family at all.

When I actually came to be pregnant, it was during the first Covid Lockdown, and so things were radically different, but I had also taken some steps to reflect on my working life, and create some stability following a period of research funded by DYCP in 2019. When I was pregnant I was working on a 3/4 days pw long project contract on a freelance basis – to my understanding an equivalent to a p/t fixed term contract if I were employed. The company recruited maternity cover for me for 9 months – to be revisited at a later date. When I informed them that I would continue my maternity leave for 12 months (taking unpaid leave – made possible by my partner’s work) I was, in the end, not offered to return to the role.

There was some miscommunication between me and the company about the status of my return to this role, discussed at about 4/5 months when my cover had to leave the role. I had understood I would be able to return to it in an adapted way to suit my new caring responsibilities – this turned out not to be the case.

My understanding now is that if I had agreed to return within 9 months, and to the same responsibilities as before (including touring) they would have offered me the role back, or I would dhave had grounds to dispute. But my request to change responsibilities was the issue. As I was not an employee I had no grounds for rights to return to the same role. But it still felt like a blow, and that my contribution to the project and company was not respected or valued, particularly in relation to how/when we communicated about my return to the role and the notice I was given.

Learnings:

  • Double check your rights before notifying clients of your pregnancy. Use resources (like the links in this blog) to try and get your head around the details and provisions for freelancers
  • If you are planning to start a family, and have any longer term contracts, it could be worth understanding if your work could be deemed an employee and seeing if you can change your contract to a employee
  • It’s really hard to know how you will feel, and what your financial situation will be like, so you have to make the decisions best for you as you can at the point of going on leave, and adapt throughout the parental leave period. This can be tough, especially if like me you were already overwhelmed with keeping a small human alive! Regular planned check ins could have helped me in my case
  • Make contact with peers, colleagues or anyone in a similar situation to discuss and share experiences!
  • Pre-arrange paid KIT days/meetings with your project/s, collaborators and contractor/s BEFORE going on leave –  if you plan/expect to return. I suspect that had I pre-agreed more KIT sessions/meetings we may have discussed the project and my circumstances with more clarity and both parties would have been able to make joint/informed decisions. This feels particularly important if you have invested time and relationships with artists/partners etc. You may wish to join meetings and to keep in touch with artists etc. (I did this just on my own to an extent, but didn’t feel able to do it as much as I’d have wished as my circumstances were unclear)
  • Arrange specific sessions (with yourself and clients) to think and talk about returning to work at 4 or 5 months, 7 or 8 months into leave etc.
  • Review what you think you will be able to do in terms of roles and responsibilities (i.e. for me it became clear that I would need to adapt and not tour with artists in the same way, as my partner’s work patterns are long and unsocial hours)
  • Investigate childcare options early on even if you are unsure what your requirements will be – it is useful to understand costs and variables in order make your own work plans
